They have argued that a successful company like J&J cannot benefit from bankruptcy protections aimed at people with debt problems.

LTL filed a second bankruptcy in just two hours following the dismissal, saying that its second attempt was different because it had less money and had more support for an agreement.

While a group of law firms representing plaintiffs is in favor of the offer, another group opposes the move.
Earlier this week, the opposition group, called the Official Committee of Talc Claimants requested the bankruptcy court to disqualify the petition by argument that LTL can not be considered to be in financial trouble.
“The filing is an incredibly legal and ineffective attempt by a small number of law firms to try to stop claimants from deciding on the resolution, which that the overwhelming majority of claimants favor,” J&J’s litigation chief Erik Haas, said in an announcement. Laura mercier talc asbestos. “The law firms who filed this filing have financial interests that conflict with, diverge from and oppose the interests which their clientele. We’ll submit a response before the court of appeals.”
Laura mercier talc asbestos. Clay Thompson, a lawyer for MRHFM who includes more than mesothelioma clients who have filed lawsuits against J&J for bankruptcy, told the company’s second bankruptcy try will fail.
“J&J publishes press release about how wonderful its plans are, but is requesting that details of the plan, such as what the individual sick individuals would be treated to,” Thompson said in a statement. “What do they have to keep secret?”
Kaplan has directed the parties to develop a new arrangement plan under supervision by two mediators.
As of February 2022 Kaplan confirmed J&J’s recourse to Chapter 11 to hasten a settlement that would release the company from the thousands of lawsuits regarding its talcum products.
But in the month of January, an appeals court in the United States overturned the ruling, ruling that the company was not able to be considered to be in “financial trouble.”
In the event that J&J’s request to challenge the U.S. Supreme Court was dismissed at the end of April J&J was granted a second petition for bankruptcy about two hours later. In response to that move, Kaplan froze the lawsuits for 60 days to decide whether to grant to file for bankruptcy again.

In a statement this week, U.S. Trustee Andrew R. Vara wrote that the doors of the bankruptcy court are “open to honest but unfortunate debtors.” Those doors “are not open to any parties that don’t have a legitimate bankruptcy purpose or that seek to use the bankruptcy process to delay or hinder their creditors.” Vara continued.
For its part, J&J maintains there is no proof conclusive that their Talc products, which includes its popular baby powder can cause cancer. J&J has taken its products off of the market first to be available in North America in 2020–and the rest of the world next year.
J&J wants to avoid the costly business of going to court. The company has won the majority of cases decided during trial, however, some losses have been severe.

Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Laura Mercier Talc Asbestos
June 2 2023 Update: In an asbestos talc court trial held in California yesterday, technical issues halted the opening statements of the defense attorneys. Laura mercier talc asbestos. Jurors who were watching from their homes via Zoom, did hear Johnson & Johnson’s lawyer expressing skepticism about the 70s science claiming asbestos was present in their product before the opening was abruptly ended.
The plaintiff was able to introduce its first expert witness Arthur Langer. Langer explained that the occurrence of other minerals alongside talc is expected. He said that his team had notified J&J in 1971 of the presence of chrysotile asbestos in the company’s talc, albeit at just 0.1 percent. He also discovered more asbestos in the year 1976.
June 1st, 2023 Update Laura mercier talc asbestos. This is the first court trial that has taken place since J&J took the decision to disband its talc division, and then declare bankrupt marks an important moment within the ongoing litigation drama. The trial started yesterday in the poignant case of a young, 24-year-old plaintiff, diagnosed with a rare and aggressive form of mesothelioma earlier this year. which lawyers on both sides acknowledge is a harrowing tragedy.
Opening statements revealed the distinct differences between each side’s story. The attorney representing the plaintiff took aim at Johnson & Johnson, alleging the use of deceitful tactics in research practices and throughout the litigation process. As per the lawyer, Johnson & Johnson attempted to alter the definition of asbestos in spite of internal documents dating from 1998 and 1994 that show asbestos fibers that were found in the tissue of the plaintiff are included.
Johnson &J’s highly uncertain $8.9 billion settlement is hanging in the balance with the progression of this trial. Despite the distinctive nature of the mesothelioma trial and the unique issues it faces compared to most talcum powder lawsuits and a decision in favor of the plaintiff could inflict an enormous setback for J&J’s expectations of widespread acceptance of their proposed settlement among plaintiffs.
May 31st, 2023: Update from Johnson & Johnson’s bankrupt talc unit is defending its two-time Chapter 11 filing in the face of challenges from victims of talc injuries. In an opposition filed with the New Jersey bankruptcy court, it argued that the case was distinct from the previous filing. The subsidiary emphasized the record-breaking commitment of $8.9 billion by J&J which is the largest settlement ever made in a mass tort bankruptcy case. Laura mercier talc asbestos. The issue is not discussed: whether this amount indicates that it is an equitable settlement. J&J also claimed support from several plaintiffs’ legal firms representing over the 60,000 plaintiffs. This is difficult to verify but it’s likely to be false.
May 24, 2023 Update: Since Johnson &J Johnson’s bankruptcy filing, the first trial involving its cosmetic talc products allegedly comprised of asbestos is set to begin jury selection on Monday, May 24, California within the Alameda County Superior Court, which is a well-known location for plaintiffs. The plaintiff claims that his mesothelioma resulted from asbestos exposure in J&J’s product and the company does not deny. The trial also involves six retailers who are accused of selling talc-based products.
May 22, 2023 Update: Lawyers involved in the 2nd J&J Talc bankruptcy are battling over who should be appointed to the role of future claims representative. This is an important role important to resolving the talc claims. Laura mercier talc asbestos. Randi Ellis, a lawyer who is frequently involved in MDLs throughout the United States, was appointed as the claims representative in the previous bankruptcy. J&J’s defense team wants Ellis to be named to the position in the future, however lawyers representing the plaintiffs in talc are arguing because Ellis has an interest conflict that would prevent her from taking on that role again. This conflict is rooted in the reality that Ellis was reportedly involved in drafting the controversially disputable second bankruptcy, which raises questions about her capability to remain neutral. It’s true that this bankruptcy will likely to get dismissed anyway.
May 17th, 2023 Update: The pretend company that J&J created for the talc litigation bankruptcy informed the New Jersey bankruptcy court that they had allocated $400 million to settle the allegations made by states who accuse the company of deceptive advertising for its talc product. Laura mercier talc asbestos. So that makes it an $8.5 billion settlement for cancer sufferers. It is hard to imagine an eventuality where J&J will be able to push these baby powder settlements through with these numbers. Although J&J’s $8.5 billion offer might seem like a lot initially, it will not look very appealing when you look at the numbers. This settlement offer based on our rough calculations would not provide victims with much more than an average settlement $100,000 per instance. That is not enough.
May 15th, 2023 update: J&J may be in the middle of a suit from an advocacy group representing cancer patients. Laura mercier talc asbestos. The group claims J&J deliberately retracted an $61.5 billion contract for funding in conjunction with its affiliate, LTL Management LLC, in order to create a false sense of financial distress and confirm the unit’s Chapter 11 bankruptcy filing. The group argues that this act could be interpreted as a fraudulent transfer of right to compensation for victims. They intend to investigate J&J’s actions after the announcement of the denial of the first bankruptcy case of LTL.
May 10 2023 Update: Next week, next week, the U.S. Bankruptcy Court in New Jersey will hear oral arguments regarding a motion to reject the second bankruptcy filing from J&J LTL Management, J&J’s subsidiary. LTL Management. In the meantime, this bankruptcy court has issued an order which requires both sides to participate in a second settlement mediation with the hopes of achieving it will be possible to reach a global settlement agreement brokered.
May 5, 2023: Update on Talc supplier Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to numerous lawsuits alleging that its Talc products caused cancer from asbestos exposure. Laura mercier talc asbestos. More than 2700 people have filed lawsuits against the company, and it was paying $1 million per month to defend its legal position. The company’s recent $29 million settlement in South Carolina forced it to apply for bankruptcy protection and argue for an equitable distribution of assets between talc claimants rather than being taken over through the receiver. Other suppliers of talc have filed for bankruptcy due to lawsuits.
May 4 2023, Update U.S. bankruptcy judge Michael Kaplan has directed Johnson & Johnson to resume talks with lawyers who rejected the proposed $8.9 billion offer for settlement. At Trenton, New Jersey yesterday, the parties gathered in court to discuss the next steps in this second case of bankruptcy. Judge Kaplan pushed more settlement talks.
This is the best way to settle these claims for J&J. A settlement for baby powder can be completed. Laura mercier talc asbestos. However, it will require more money, more billions of dollars coming from Johnson & Johnson.
Lawyers are divided over whether to accept the proposal and not every client sees the situation the same way their attorney does. A second bankruptcy proceeding is bound to fail and Judge Kaplan has scheduled a hearing in June to decide whether to remove the bankruptcy after the second.
May 3, 2023 Update: A group representing cancer patients suing Johnson & Johnson (J&J) requested for the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is a bid to stop litigation regarding talc-related products. The group representing claimants for talc filed a motion on Tuesday requesting for the Third Circuit to consider their case and to send it back before a court of lower jurisdiction with instructions to dismiss the bankruptcy. Laura mercier talc asbestos. They also asked that halted tort litigation against J&J allow the litigation to proceed.
LTL filed for Chapter 11 protection once again following its bankruptcy filing that was rejected in the Third Circuit earlier this year which offered the possibility of an $8.9 billion agreement. The committee argues that the recent ruling allowing LTL’s third Chapter 11 to continue, as well as halting the trials against J&J should be subject to an immediate Third Circuit review. The US Trustee also asked that the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s worldwide vice president of litigation, Erik Haas, was quoted by Bloomberg as saying that J&J plans to file a response in the appeals court, calling the request a “desperate and legally inadequate move” by a few of law firms that have competing financial interests.
May 1, 2023 Update: One question people keep asking is how could plaintiffs and their attorneys turn off $8.9 billion. Of course, that is a lot of money. However, there are lots of victims. Laura mercier talc asbestos. They are a great case for plaintiffs. We were reminded of this last week with two talc trials have resulted in huge verdicts for the plaintiffs. In February mesothelioma cases, a talcum powder trial in Oregon was settled with an award in the amount of $18.1 million. The following month, a second mesothelioma-related talc case went to hearing in South Carolina and resulted in a verdict of $29 million for the plaintiff. In both instances, the defendant was Whittaker, Clark & Daniels Inc., one of the most prominent suppliers of talc in the U.S.
April 30 2023 Update: In the year 2023, when J&J first attempted to drag the litigation over talcum powder into bankruptcy, it did so with the option of putting aside $2 billion to settle the case. The amount was absurdly low. None of the talc plaintiffs were in favor of the proposal. This time, J&J has increased the offer to $8.9 if the talc plaintiffs will allow a bankruptcy settlement and they also have the backing of a significant section of the talc victims as well as their lawyers. Laura mercier talc asbestos. But with 75% of plaintiffs in the talc category, which is necessary for bankruptcy plan approval, it a tough road because of the number of lawyers who have massive inventories of baby powder litigations opposed towards the agreement.
What are the solutions to the impasse? More billions.
April 25 2023 update: Talc Cancer victims have sought a court order to dismiss the Chapter 11 case filed by LTL Management LLC, a absurdly made-up Johnson & Johnson subsidiary, declaring that the company isn’t financially strained. LTL filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby powders caused cancer. Laura mercier talc asbestos. It was the 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said the company wasn’t eligible for bankruptcy relief since it had not demonstrated financial difficulties.
The claimants argue that the 2nd Chapter 11 case is an abuse of the bankruptcy system and it is being pursued in bad faith. J&J asserts that the bankruptcy settlement has “significant support” from the firms that represent an estimated 60,000 plaintiffs. It’s fair to say that the plaintiffs’ attorneys and the victims are split over their disagreement over the $8.9 billion offer for settlement.
April 21st, 2023 Update: A bankruptcy judge decided in favor of Johnson & Johnson must face new lawsuits alleging that it sold tainted baby powder causing cancer. Even though trials for the talc lawsuits have been suspended for a minimum of 60 days but new lawsuits can be filed and lawyers will begin preparing their cases. Laura mercier talc asbestos. The judge expressed skepticism over J&J’s absurd attempt to revive its strategy by filing a second bankruptcy trial.
April 13th, 2023: Update on the most important announcement is an $8.9 billion over the course of 25 year period settlement offered. Lawyers representing cancer patients in MDL class action MDL Class Action have vowed to fight the settlement alongside the talc claimants. Why? They argue that it’s too little money for the those suffering from cancer who are 70,000. Laura mercier talc asbestos. These lawyers argue that J&J should negotiate a larger settlement or even litigate individual claims if the most recent bankruptcy is thrown out.
But there’s a separate lawyer group that isn’t part of the leadership in that class action. They have amassed many thousands of cases. This group wants to settle now with what they believe is less than these victims deserve. The argument they make is two-fold. They argue that the settlement – which amounts to 100 million dollars on average per plaintiff is fair.
This is an argument that is difficult to make. The second argument is more force: the victims can now not wait and they want to get their money right now.
April 12 2023 Update: Many are looking for ways J&J could file for bankruptcy once more. The answer is complicated and convoluted. However, let’s attempt to explain the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only option to settle both present and future lawsuits involving talc conclusively. It thinks it can get a lower rate when there is a bankruptcy element that creates pressure to negotiate a settlement. Laura mercier talc asbestos. Going back to the 400-year span of American history, the firm argues that bankruptcy benefits all parties as it distributes settlements more equally and efficiently than trial courts, where litigants are awarded significant awards while others receive nothing.
The gist of the 3rd Circuit decision was this is not a case of one that makes a profit, but an entity to assume the legal burden and declare bankruptcy, which is what Congress thought of when drafting its Bankruptcy Code. But it also said it was not in financial distress because J&J promises unlimited funding.
So J&J took advantage of the unlimited funding aspect of the deal and didn’t make any promises that it would provide unlimited funds for cases. The company claims that its revised financing arrangements with its subsidiary address appeals court’s concerns, while offering claim payment funds. As if offering victims less money would solve the problem at hand.
Attorneys representing cancer patients who do not agree with the agreement counter this with what you conclude is countering legal nonsense legal nonsense: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s ruling. Hyperbole was not spared attorneys representing the victims claim it the largest “fraudulent transaction in United States history.”
Despite the legal jargon, J&J does not really believe this bankruptcy will be able to last. But it is a way of pushing this $8.9 billion settlement to keep pressure on plaintiffs.
April 10, 2023 Update Bloomberg is running an intriguing article on a new law in New Jersey that is shedding new light on litigation funding in the class action lawsuit. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of lawsuits in the case of Johnson & Johnson (J&J) over talc products in exchange for a share of any profits. J&J has now offered an offer of $8.9 billion to settle all lawsuits.
The involvement of funders is made public due to the New Jersey court rule requiring the release of certain details about outside funding backers. This rule is intended to address the rising calls for regulation of litigation funders. J&J is facing more than 60,000 claims when you include state and federal baby powder lawsuits. Third-party funding of mass tort cases is not without its pros and cons. But there is no question that we are witnessing how third-party funding can level the playing field between individual and big corporations in the courtroom.
April 4 2023 Update: It is fun to watch the worm turn in this case. J&J has taken another blow this week when the Third Circuit denied J&J’s request to maintain the automatic stay during the time that J&J appeals an appeal to the U.S. Supreme Court. It has halted the cases of talcum powder in a number of years and stopped the filing of new lawsuits ever since J&J initiated the controversial effort to spin the talc debts into a bankrupt company over one year ago. Laura mercier talc asbestos. After the 3rd Circuit ruled that this bankruptcy was invalid a few months ago, the stay was revoked. J&J was hoping to have it stayed in place until its SCOTUS appeal. However, the answer was no.
April 1st, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. There is a chance that is that the Supreme Court is willing even to consider the appeal? Low.
March 16th 2023 Update: with the bankruptcy stay now in effect, the first new cases were filed and incorporated into the class action for talcum powder MDL within a year. Seven new talc cases were brought into the MDL during the month of March increasing the number of pending cases up to 37,522.
February 25, 2023 Update: A Congressmen from Tennessee is now calling for the U.S. Government Accountability Office (GAO) start an investigation to determine how much J&J products containing talc have cost the government over the decades.
A recent email to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of ignoring the dangers of its talc product for long while tax dollars spent on treating people who suffered injuries from exposure to the product. This lawsuit comes a few weeks following J&J’s dramatic loss in the 3rd Circuit Court of Appeals.
Laura mercier talc asbestos. J&J should begin to make fair settlement offers to victims to getting this behind. It is a stain on one of the greatest firms.
February 14 2023 Update: In an earlier hearing at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention to follow his 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
