As of February 2022 Kaplan affirmed the ability of J&J’s use of Chapter 11 to hasten a settlement that will free J&J from the tens of thousands of claims over its talcum products.
In the month of January, an appeals court in the United States overturned the decision, ruling that the company could not be considered in “financial financial distress.”

Johnson & Johnson’s uncertain $8.9 billion settlement is hanging in the balance with the course of this trial. May 22nd, 2023 Update Lawyers in the 2nd J&J talc bankruptcy are fighting over who should be chosen to fill the post of future claims representative. This is which is vitally essential to the resolution of the claim for talc. Himalaya baby powder has talc. Randi Ellis, a lawyer who is frequently involved in MDLs throughout the country was appointed the claims representative in the previous bankruptcy. J&J’s defense team would like Ellis to be appointed to that role yet again, but the lawyers for the talc plaintiffs are protesting because Ellis has a conflict of interest that should prevent her from being appointed to that post for the second time. The dispute stems from issue that Ellis was involved in drafting the hotly disputable second bankruptcy, which raises questions about her capability to remain neutral. It’s true that this bankruptcy could be tossed out anyway.

Himalaya baby powder has talc. This amounts to an $8.5 billion settlement to cancer victims. It’s difficult to envision an eventuality where J&J can get the baby powder settlements in these figures. While J&J’s proposed $8.5 billion offer might seem like a huge sum initially, it does not appear appealing after you calculate the figures. The settlement plan based on our estimates – will not provide victims with much more than $100,000 per instance. That’s not enough.
May 15 2023 update: J&J could be facing lawsuit from an advocacy group that represents cancer victims. Himalaya baby powder has talc. The group claims that J&J deliberately retracted an $61.5 billion financing agreement together with its parent company, LTL Management LLC, to simulate financial distress and to validate the company’s Chapter 11 bankruptcy filing. The group claims that this move amounts to a fraudulent transfer of rights of compensation for victims. They intend to investigate J&J’s actions after the announcement of the denial of the LTL’s bankruptcy case in its first instance.

The company’s recent $29 million settlement on the state of South Carolina forced it to pursue bankruptcy protection, and arguing for an equitable distribution of assets between talc claimants rather than being taken through the receiver. Other talc suppliers have also been forced to file for bankruptcy as a result of the litigation.
May 4, 2023, Update U.S. bankruptcy judge Michael Kaplan has directed Johnson & Johnson to reopen talks on settlement with lawyers who have rejected the company’s proposed $8.9 billion settlement offer. The court in Trenton, New Jersey yesterday, the parties appeared in court to discuss the next steps for the second bankruptcy case. Judge Kaplan was pushing for more settlement discussions.
This is the way to settle these claims for J&J. The baby powder settlement is likely to get done. Himalaya baby powder has talc. However, it’ll require more money, more billions of dollars from Johnson & Johnson.
Lawyers are divided over whether or not to agree with the proposal and not every client views the issue in the same manner their lawyer does. The second bankruptcy case is bound to fail with Judge Kaplan has set a date for a hearing in June to determine if she will remove the bankruptcy after the second.
May 3 2023 Update A group of cancer victims suing Johnson & Johnson (J&J) asked for the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to halt the litigation involving talc products. Himalaya baby powder has talc. The committee also requested that the lawsuit against the halted torts of J&J should be permitted to continue.
LTL requested Chapter 11 protection once again after its first bankruptcy filing was rejected in the Third Circuit earlier this year with the possibility of an $8.9 billion agreement. The committee believes that the recent decision allowing LTL’s 2nd Chapter 11 to continue, as well as halting the trials against J&J and J&J, requires an immediate Third Circuit review. The US Trustee also requested that be the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice president of litigation Erik Haas, was quoted by Bloomberg as saying that J&J intends to file a statement in the appeals court, calling the request a “desperate and legally inadequate plan” by a handful of law firms that have competing financial interests.
May 1 2023 Update: One most frequently asked question is how could the plaintiffs’ lawyers and their clients turn off $8.9 billion. That’s of course quite a sum. But there are a lot of victims. Himalaya baby powder has talc. They are a great cases for plaintiffs. We were reminded recently in two talc trials which have resulted in huge verdicts for plaintiffs. In February mesothelioma, a talcum-based powder trial in Oregon was settled with a verdict that was $18.1 million. The following month, a second talc mesothelioma case went to hearing in South Carolina and resulted in an award of $29 million on behalf of the plaintiff. It was the same defendant as in these cases: Whittaker, Clark & Daniels Inc. One of the leading suppliers of talc within the U.S.
April 30th 2023 Update: In the year 2023, when J&J first tried to bring the talcum powder lawsuit into bankruptcy, it did so with an offer to reserve $2 billion to settle the case. The amount was absurdly low. All of the talc plaintiffs agreed with it. This time around, however, J&J has increased the offer to $8.9 If the talc plaintiffs are willing to accept bankruptcy settlements and they have the support of a substantial portion of the talc plaintiffs as well as their lawyers. Himalaya baby powder has talc. However, 75% of plaintiffs of talc are needed for approval of the bankruptcy plan is not an easy task since there are so many lawyers with huge inventory of baby powder-related lawsuits, opposed against the proposed settlement.
What is the solution to this impasse? More billions.
April 25, 2023 Update Talc cancer claimants have asked a judge to dismiss the Chapter 11 case filed by LTL Management LLC, a absurdly-made-up Johnson & Johnson subsidiary, which claims that the business is not financially troubled. LTL requested Chapter 11 to settle tens of thousands of claims that J&J’s baby powders caused cancer. Himalaya baby powder has talc. LTL was denied Chapter 11 in January. 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said LTL was not a candidate for bankruptcy relief as it was unable to demonstrate financial distress.
The claimants contend that the third Chapter 11 case is an fraud on the bankruptcy system, and that it’s being pursued in bad good faith. J&J states that the bankruptcy settlement receives “significant support” from the firms that represent around 60,000 claimants. It is fair to say that the plaintiffs’ attorneys and the victims are split over their disagreement over the $8.9 billion deal.
April 21, 2023 Update: A bankruptcy judge has ruled the company Johnson & Johnson must face new lawsuits alleging that the firm sold a baby powder that contained a chemical that causes cancer. While trials in Talc lawsuits are suspended for at least 60 calendar days, new lawsuits can be filed, and lawyers are able to begin preparing their cases. Himalaya baby powder has talc. Judges expressed doubt about J&J’s ridiculous effort to revive its plan with another bankruptcy case.
April 13th, 2023: Update on the big announcement is an $8.9 billion over 25 year period settlement offered. Lawyers representing cancer patients involved in the MDL class action have promised to challenge the settlement those who claim talc. Why? They argue that it’s too little money for the those suffering from cancer who are 70,000. Himalaya baby powder has talc. These lawyers argue that J&J should seek a bigger settlement or pursue individual claims in the event that the latest bankruptcy is declared unconstitutional.
However, there is a second group of lawyers outside of the leadership in this class action. The lawyers collectively have accumulated the equivalent of tens of thousands of lawsuits. They want to settle the case now for what many argue is far less than what these victims deserve. Their argument appears to be twofold. The first is that they claim the settlement – about 100 million dollars on average per plaintiff is fair.
That is a hard argument to prove. However, their second argument has more force: the victims can not afford to wait any longer and need to get their money right now.
April 12, 2023 Update: People are asking how J&J is able to file for bankruptcy again. The answer is complicated and confusing. However, let’s attempt to explain it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only way to settle both present and future talc-related lawsuits definitively. It believes that it will be less expensive if there is the bankruptcy element which applies pressure for a settlement. Himalaya baby powder has talc. Driving past 400 years of American history, the company asserts that bankruptcy benefits everyone by dispersing settlement payments more equitably and efficiently than trial courts, where some litigants receive significant award while others do not.
The essence in this 3rd Circuit decision was this is not a case – the profit-making company that has an entity to assume the legal responsibility and declare bankruptcy – something Congress contemplated when drafting the Bankruptcy Code. It also clarified that the subsidiary was not financially crisis due to the fact that J&J promised unlimited funding.
So J&J did not hesitate to take advantage of the funding unlimited part of the agreement and did not promise to offer unlimited funding for litigation. The company says that its revised financing arrangements with its subsidiary will address concerns of the appeals court while providing funds for claims. It’s as if giving victims lesser money could solve the overarching problem.
Attorneys representing cancer victims who oppose the agreement counter this argument by saying that it is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s previous decision. Hyperbole did not go unnoticed attorneys representing the victims claim it the largest “fraudulent move in United States history.”
Despite the legal jargon, J&J does not really believe this bankruptcy will be able to last. However, it’s a means of trying to push this $8.9 billion settlement, and to keep the pressure on plaintiffs.
April 10, 2023, Update Bloomberg has an interesting piece on a law that has been passed of New Jersey that is shedding new light on the funding of litigation in the Class action suit. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of claims that were brought against Johnson & Johnson (J&J) regarding talc products, in exchange for a share of any settlements. J&J is now offering the payment of $8.9 billion in settlements for all lawsuits.
The involvement of the funders is made public because of an New Jersey court rule requiring the disclosure of certain information about funders outside the state. This rule is intended to tackle the growing demands for the regulation of litigation funders. J&J has more than 60,000 claims when you combine state and federal child powder-related lawsuits. Third-party funding in mass tort claims is not without its pros and cons. However, there is no doubt that we are witnessing how third-party funding can level the playing field for individuals and large corporations in court.
April 4 2023 Update: It is interesting to watch the worm turning in this litigation. J&J took another hit this week, when an appeals court in the Third Circuit denied J&J’s request to keep the automatic stay in place during the time that J&J appeals an order granting bankruptcy to the U.S. Supreme Court. It has stopped thousands of talcum powder cases and prevented new lawsuits from arising ever since J&J initiated the controversial effort to spin the talc liabilities into a bankrupt company over a year back. Himalaya baby powder has talc. After it was decided that the 3rd Circuit ruled that this bankruptcy was insufficient only a few months back, the stay was removed. J&J had hoped to have it stayed in place until an appeal to the SCOTUS appeal. The answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance is that the Supreme Court is willing even to take up the appeal? Low.
March 16 2023 Update: With the bankruptcy stay having been officially lifted, the first new cases have been filed and transferred into the class action for talcum powder MDL in just over a year. Seven new talc-related lawsuits were added to the MDL over the last month and brought the total number of cases pending to 37,522.
February 25 2023 Update This morning, a Congressmen from Tennessee is now requesting that the U.S. Government Accountability Office (GAO) launch an investigation into how much J&J products containing talc have cost the government in the many years.
Recently, in an open letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) in a recent letter to the GAO, Rep. Steven Cohen (D-Ten. J&J of failing to recognize the dangers of its talc products for many years, while tax dollars were used to treat those who were injured through exposure to the products. The demand comes just weeks after J&J’s major loss in the 3rd Circuit Court of Appeals.
Himalaya baby powder has talc. J&J has to begin making reasonable settlement offers to victims, in order to put all of this behind. This is a blemish on one of the most prestigious businesses.
February 14 2023 Update: During an appearance today at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention in light of the 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
