J&J affiliate LTL Management filed a bankruptcy plan in New Jersey late on Monday which outlines how the company intends to pay different types of cancer patients in a bankruptcy settlement. April 12 2023 Update: Some people are wondering if J&J can file for bankruptcy once more. The answer is complicated and confusing. Let’s try to clarify the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only method to deal with both present and future talc-related lawsuits definitively. Also, it believes that it will be less expensive when there is an element of bankruptcy that puts pressure to settle. Can talc cause testicular cancer. Going back to the 400-year span of American history, the company argues that bankruptcy benefits all parties because it distributes settlement payments more evenly and effectively than trial courts, which are where litigants get significant awards while others receive nothing.
The basic tenet in this 3rd Circuit decision was this is not a matter of an enterprise that is profitable, forming an entity to assume the legal burden and declare bankruptcy – Congress considered when it was drafting the Bankruptcy Code. Attorneys representing cancer patients who oppose the agreement counter this argument by saying that it is countering legal nonsense legal nonsense: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s earlier decision. Hyperbole was not spared the lawyers representing victims call it the biggest “fraudulent deal in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really believe that this bankruptcy will last. But it’s a way to try and push the $8.9 billion settlement through and maintain pressure on plaintiffs.
April 10, 2023, Update Bloomberg has an interesting article on a new law in New Jersey that is shedding new light on litigation funding in the baby powder class action lawsuit. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of claims in the case of Johnson & Johnson (J&J) regarding talc products, in exchange for a share of any wins. J&J is now willing the payment of $8.9 billion to settle all lawsuits.
The involvement of the funders is made public due to a New Jersey court rule requiring the release of certain details about outside funding backers. The rules aim to address the growing calls for regulation of litigation funders. J&J has more than 60,000 claims when you add up state and federal infant powder litigation.
